1. Acceptance of Terms

By purchasing, downloading, or accessing the Insurance Agent's Lead Automation Blueprint ("the Product") from OnboardedAgent.com ("we," "us," "our"), you ("you," "Customer") agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not purchase or use the Product.

2. The Product

The Product is a digital educational resource consisting of a PDF blueprint, templates, scripts, and supporting materials designed for licensed insurance agents. The Product is delivered electronically via email after purchase. No physical goods are shipped.

3. License to Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Product for your own personal and professional use as a licensed insurance agent. This license is tied to the email address used at checkout. You may NOT:

• Resell, redistribute, copy, share, forward, mirror, or otherwise transfer the Product to any third party, whether for compensation or not
• Post the Product or any portion of it on any file-sharing, cloud storage, forum, Discord, Telegram, or public platform
• Use the Product or its contents to train, fine-tune, or condition any AI model, language model, or machine-learning system
• Create derivative works, courses, templates, or products that substantially reproduce the Product's structure, prompts, or methodology for commercial sale
• Remove, alter, obscure, or tamper with any copyright notice, license stamp, watermark, or proprietary marker embedded in any file
• Use the Product in any manner that violates applicable law or insurance regulation

Buyer-specific watermarking.

Every copy of the Product delivered to a buyer is uniquely watermarked with that buyer's email address, order ID, and delivery timestamp embedded in the files. If any portion of the Product is found distributed, shared, or offered for sale by any party other than onboardedagent.com, the watermark identifies the origin buyer. Violating buyers forfeit their license without refund, may have their access revoked, and are subject to DMCA takedown action plus legal recovery of damages, legal fees, and any profits derived from the violation.

Violation of this license terminates your access immediately, with no refund. We reserve the right to pursue injunctive relief and monetary damages.

4. Payment

All payments are processed securely through Stripe. Prices are listed in US Dollars. By completing your purchase, you authorize us to charge the payment method you provide for the purchase price plus any applicable taxes. You represent that any payment information you provide is accurate and that you are authorized to use the payment method.

5. Refund Policy, All Sales Final

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS.

Because the Product is a digital good delivered immediately upon purchase, we do not offer refunds under any circumstances, including but not limited to:

• Accidental purchase or buyer's remorse
• Failure to implement the material
• Results that differ from your expectations
• Disagreement with the content
• Technical issues on your end (we are available to help troubleshoot)

By purchasing the Product, you acknowledge that you have read this Refund Policy, that it is a material term of your purchase, and that you waive any right to a refund or chargeback. Initiating a chargeback through your credit card provider in violation of this policy may result in legal action to recover the disputed amount plus fees.

If you experience technical difficulties accessing the Product, contact us at support@onboardedagent.com and we will work with you to resolve the issue. Delivery issues are not grounds for a refund.

6. Intellectual Property

All content in the Product, including text, scripts, frameworks, templates, methodologies, graphics, and design, is the exclusive intellectual property of OnboardedAgent.com and/or its licensors, protected by US and international copyright and trademark law. Your purchase does not transfer ownership of any intellectual property to you.

7. No Guarantee of Results

The Product is an educational resource. We make no representations or warranties that using the Product will generate any specific amount of leads, sales, revenue, or business outcomes. Your results depend on your individual effort, skill, market conditions, regulatory environment, and many other factors outside our control. Prior results shared anywhere in our marketing materials do not guarantee similar results for you.

8. Not Professional Advice

The Product is educational material only. It does not constitute legal, financial, tax, compliance, regulatory, or insurance-specific professional advice. You are responsible for ensuring that any tactics, systems, or templates you implement from the Product comply with:

• Federal laws including CAN-SPAM, TCPA, and FTC marketing rules
• State insurance department regulations in every state where you are licensed
• CMS Marketing Rules for Communications (MRCs) if selling Medicare products
• Your carrier agreements and appointment contracts
• Any other applicable laws, rules, or contractual obligations

Before implementing any practice described in the Product, consult with a qualified attorney, compliance officer, or other professional as appropriate for your specific situation and jurisdiction.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OnboardedAgent.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR PURCHASE OR USE OF THE PRODUCT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS, LOST DATA, REGULATORY PENALTIES, OR CHARGEBACKS FROM CUSTOMERS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.

10. Indemnification

You agree to indemnify, defend, and hold harmless OnboardedAgent.com, its owner, and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Product; (b) your violation of these Terms; (c) your violation of any law or regulation in connection with your use of the Product; or (d) any third party's claim that your use of the Product caused harm to them.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Product shall be resolved exclusively through binding arbitration in Miami-Dade County, Florida, administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to a jury trial or to participate in a class action. If arbitration is unavailable, disputes shall be brought in state or federal court located in Miami-Dade County, Florida.

12. Privacy

When you purchase the Product or submit your email for Chapter 1, we collect your name, email address, and (via Stripe) payment information. We use this information to:

• Deliver the Product and any related content you requested
• Send you occasional marketing emails about related products (you may unsubscribe at any time)
• Comply with legal obligations

We do not sell your personal information to third parties. Payment information is handled entirely by Stripe under their privacy policy. Email delivery is handled by Resend. We retain your information only as long as necessary for the purposes above or as required by law.

13. Modifications to Terms

We may update these Terms at any time. Changes take effect when posted to this page. Your continued use of the Product after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email where possible.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
